FairTalk is currently in pre launch. These terms apply to use of the waitlist, website, and any beta access provided. Full terms covering the app will be published prior to launch.

1. Acceptance of terms

By accessing or using the FairTalk website (fairtalk.io), joining our waitlist, or using any FairTalk service, you agree to be bound by these Terms of Use. If you do not agree, please do not use our services.

2. About FairTalk

FairTalk is an AI powered conflict resolution and communication tool designed to help individuals work through disagreements in a structured, empathetic, and private environment. FairTalk is a self guided support tool only. It is not a professional medical, psychological, therapeutic, or legal service.

3. Not a substitute for professional help

FairTalk is not a licensed mental health service, counselling service, psychological service, medical service, or legal service. Nothing within the FairTalk platform constitutes professional medical, psychological, therapeutic, psychiatric, or legal advice. FairTalk is not designed to diagnose, treat, cure, or prevent any mental health condition, medical condition, or legal matter.

If you or someone you know is experiencing a mental health crisis, thoughts of self harm or suicide, domestic violence, or any situation requiring urgent professional intervention, please stop using FairTalk and contact emergency services or a qualified professional immediately.

FairTalk strongly encourages users to seek independent professional advice from licensed practitioners for any serious personal, relationship, psychological, or legal matters. Use of FairTalk does not replace and should not be treated as a substitute for professional help.

4. Eligibility

You must be 18 years of age or older to use FairTalk. By using our services, you confirm that you meet this requirement.

5. User conduct

When using FairTalk, you agree not to:

Use the service for any unlawful purpose
Upload or share content that is abusive, threatening, or discriminatory
Attempt to record or capture another party's session without their consent
Circumvent any consent or privacy controls built into the platform
Use the platform in a way that could harm another participant

6. Consent to recording

FairTalk's mediation sessions involve audio recording and transcription. Both participants must provide explicit within app consent before any recording begins. Audio files are deleted immediately after transcription. Transcripts are stored securely and accessible only to the linked participants, and may be deleted by users at any time within the application.

7. Limitation of liability

To the maximum extent permitted by applicable law, FairTalk, its founders, employees, and contractors shall not be liable for any loss, damage, injury, or harm — whether direct, indirect, incidental, consequential, or otherwise — arising from or in connection with your use of the FairTalk platform or any reliance on content or analysis provided by FairTalk.

FairTalk expressly disclaims any liability for decisions made or actions taken by users based on AI generated analysis, summaries, or recommendations produced by the platform. You acknowledge that AI generated content may be incomplete, inaccurate, or unsuitable for your specific circumstances and should not be solely relied upon.

FairTalk's total liability to you in any circumstance is limited to the amount you paid for the service in the preceding 12 months.

8. Intellectual property

All content, design, and technology on the FairTalk platform is owned by FairTalk and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.

9. Modifications

We may update these terms from time to time. We will notify registered users of material changes by email. Continued use of FairTalk after changes are posted constitutes acceptance of the updated terms.

10. Governing law

These terms are governed by the laws of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
